The Massachusetts House of Representatives and Senate scheduled a joint hearing for October 27, 2015 on HB262 and SB176. Both bills include identical provisions that would ban payments “to physicians, otolaryngologists or audiologists as inducements to influence the recommendation of the purchase of a hearing aid.” If enacted, this legislation would effectively end the waiver of reporting requirements for hearing aid manufacturers from the Massachusetts Pharmaceutical and Medical Device Manufacturer Code of Conduct Law. In addition, the new provisions would cover Class I and II hearing aids, even though the overall statute exempts Class I devices.
